A. Applicability
Diese Allgemeinen Geschäftsbedingungen (nachfolgend «GTC») regeln die Nutzung der Immobilienplattform der Wealth Investment Network – WENET AG durch sämtliche natürliche oder juristische Personen («im Folgenden «Users").
Users are made aware of these GTCs upon registration and by registering, the user acknowledges these GTCs and agrees to them without reservation. These GTCs apply in addition to the General Terms and Conditions and the Privacy Policy.
B. Nutzung der Immobilienplattform
Die Registrierung und Führung eines Nutzerkontos auf der Immobilienplattform ist für die Nutzer kostenlos. Durch die blosse Registrierung und Nutzung des Nutzerkontos entstehen für die Nutzer weder direkte noch indirekte Kosten.
Für die Inserierung von Objekten wird pro Inserat eine Gebühr geschuldet; die Höhe dieser Gebühr wird im Zeitpunkt der Auftragserteilung gemäss der jeweils gültigen Preisliste ausgewiesen. Änderungen eines bereits aufgeschalteten Inserats können vom Nutzer jederzeit, jedoch insgesamt nur einmal, vorgenommen werden. Bei erfolgreicher, selbstständiger Vermittlung über die Immobilienplattform ist keine Provision geschuldet.

C. Purpose of the property platform
Mit der Immobilienplattform der Wealth Investment Network – WENET AG können Inserate über Grundstücke, Häuser, Immobilien aller Art, Wohnungen, etc. (im Folgenden «Objects») Dritten zugänglich gemacht und Kontakte zu Interessenten hergestellt werden. Die Objekte müssen sich in der Schweiz befinden. Es können bereits realisierte oder projektierte Kaufobjekte sowie Bauland inseriert werden. Die Immobilienplattform dient ausschliesslich der Vermittlung von Objekten. Die Wealth Investment Network – WENET AG ist keine Partei in den Transaktionen zwischen Nutzern der Immobilienplattform. Vorbehalten bleiben separate Maklerverträge zwischen Nutzern und der Wealth Investment Network – WENET AG.
D. Registration and use
Registration and an account are required to use the property platform. Users undertake to provide accurate and complete information during the registration process. There is no entitlement to registration. Wealth Investment Network - WENET AG may refuse registration or delete users who have already registered without giving reasons.
Jeder Nutzer kann sich für maximal ein Konto registrierten. Mehrere Konten, welche direkt oder indirekt einem Nutzer zur Verfügung stehen, sind verboten. Die Nutzer verpflichten sich, ihre Zugangsdaten vertragskonform zu verwenden und diese keinem Dritten zugänglich zu machen. Die Nutzer sind vollumfänglich selber verantwortlich für die Geheimhaltung ihrer Zugangsdaten. Die Nutzer verpflichten sich, die Wealth Investment Network – WENET AG unverzüglich über jegliche unbefugte Nutzung ihres Kontos oder Sicherheitsverletzungen zu informieren.
By registering, users agree that their data may be used and processed by the Wealth Investment Network - WENET AG for offers, communications and services.
Users can request the deletion of their account and their data by sending an e-mail to the e-mail address mentioned under B.
E. Publication of advertisements
Users can advertise properties for sale on the real estate platform in accordance with B below. The user is responsible for ensuring that the following requirements for the publication of adverts are met. There is no entitlement to the publication of an advert. Wealth Investment Network - WENET AG may refuse to publish an advertisement or take already published advertisements offline again without giving reasons. By publishing the property, Wealth Investment Network - WENET AG assumes no responsibility for the content of the advertisement. Wealth Investment Network - WENET AG can correct obvious errors in the advertisement independently without consulting the user.
The following requirements must be met for the publication of adverts:
- Only properties in accordance with C may be advertised for sale.

- Das Objekt muss tatsächlich existieren.
- Eine Insertion im Auftrag, über einen Vermittler, Kollegen, Bekannte etc. oder dergleichen ist untersagt.
- The adverts must not contain any violations of personality rights, infringements of intellectual property rights, illegal or misleading content.
- Der Nutzer ist vollständig und zu 100% selbst verantwortlich für die Erfassung seiner Insertion (z.B. hochladen & erstellen von Text, Medien etc.)
- Symbolbilder sind untersagt.
- Publizierte Bilder müssen einen direkten Bezug zum Objekt haben
- Die Nutzer müssen über sämtliche Immaterialgüterrechte an publizierten Informationen verfügen.
- Both contacting the user and viewing the property must be free of charge for interested parties.
- Properties may not be advertised commercially.
- A maximum of one advert for one property is permitted per user at any one time.
Die Nutzer sind für die Richtigkeit und Vollständigkeit der Informationen in den veröffentlichten Immobilienanzeigen verantwortlich. Die Nutzer verpflichten sich, die Immobilienplattform nur für rechtmässige Zwecke zu nutzen, diese nicht für betrügerische oder unerlaubte Zwecke zu nutzen und nicht gegen geltende Gesetze zu verstossen. Die vorgenannten Bedingungen gelten auch für Änderung eines Inserats. Bis zur Freigabe der Änderung durch die Wealth Investment Network – WENET AG bleibt das Inserat bestehen.
Wealth Investment Network - WENET AG may request written proof from users before, during or after an insertion that the user is the owner of the property.
If an advertised property is sold, the advertisement must be deleted immediately. Wealth Investment Network - WENET AG may irrevocably delete adverts for sold properties or inactive adverts.
Users explicitly agree that adverts may be published on a variety of platforms. Wealth Investment Network - WENET AG determines when, how and on which platform adverts are published. It cannot be ruled out that adverts may also appear on platforms to which Wealth Investment Network - WENET AG has no access.
F. Duties of behaviour
In order to ensure the functionality of the property platform, users undertake not to undertake any actions that are incompatible with the purposes of the property platform and/or are unlawful. In particular, users undertake to refrain from the following actions:

- Listing of objects that do not exist or of which the user is not the owner.

- Inserierung von irreführenden, täuschenden oder rechtswidrigen Inhalten.

- Improper use of the property platform.

- Commercial use of the property platform.

- Multiple registrations of the same user.

- Use of false information during registration to deceive.

- Insertion of several objects at the same time.
G. Exclusion of warranty and liability
Wealth Investment Network - WENET AG accepts no responsibility for the accuracy of the information contained in the adverts or for the quality of the properties offered.
Wealth Investment Network - WENET AG is not liable for any damage caused by the use of the property platform or by transactions between users. The liability of Wealth Investment Network - WENET AG is limited to gross negligence or intent for its own behaviour. All liability is excluded to the extent permitted by law. Wealth Investment Network - WENET AG is not liable for consequential damages, loss of profit, defective technology, defective software, business interruptions and malfunctions of any kind.
Wealth Investment Network - WENET AG accepts no liability for errors or interruptions to the functions of the property platform and/or partner platforms. Wealth Investment Network - WENET AG does not guarantee access to the property platform and/or partner platforms and cannot guarantee that the property platform and/or partner platforms or the corresponding servers are free of malware.
H. Partner platforms
Wealth Investment Network - WENET AG accepts no responsibility for Partner Platforms and cannot guarantee that Partner Platforms will function properly or be available or that their content is lawful or complete. Wealth Investment Network - WENET AG accepts no liability or warranty of any kind in connection with partner platforms.
A. Intellectual property rights
By publishing an advertisement, users grant the Wealth Investment Network - WENET AG all rights to the commercial use, utilisation, reproduction, publication or modification of all information in an advertisement (including images, videos, texts, etc.).
All rights to information, elements and content of the property platform belong to Wealth Investment Network - WENET AG (in particular copyrights and trademark rights) and/or it holds all necessary rights of use. Wealth Investment Network - WENET AG is a registered trademark and may only be used by Wealth Investment Network - WENET AG. Users are not granted any licence or right to use the intellectual property rights of Wealth Investment Network - WENET AG.
B. Prohibition of the use of information
Users recognise that the information available on the real estate platform (advertisements, images, videos, graphics, etc.) is legally protected and that any use, in particular commercial use, is prohibited. It is expressly forbidden to systematically extract and/or use, publish, link or commercialise the information made available on the real estate platform in any way whatsoever.
C. Changes to the GTC and the offer
Wealth Investment Network - WENET AG reserves the right to amend these terms and conditions or its offer at any time. The amended terms and conditions will be published on the property platform and will enter into force upon publication.
There is no obligation to provide information. Users are not entitled to retain certain services, offers and functions.
D. Cancellation
Wealth Investment Network - WENET AG reserves the right to terminate contractual relationships with users at any time without notice and to delete their user account. In particular, Wealth Investment Network - WENET AG will terminate the contractual relationship without notice in the event of a breach of the GTCs, use of the real estate platform in breach of contract or other misconduct. No important reasons are required for cancellation without notice.
E. Final provisions
Should individual provisions of these GTC be or become invalid, this shall not affect the validity of the remaining provisions.
Wealth Investment Network - WENET AG may transfer rights and obligations arising from the user's contractual relationship to third parties. Users require the consent of Wealth Investment Network - WENET AG for the transfer of rights and obligations.
Swiss law shall apply, to the exclusion of international conflict of laws provisions. The place of jurisdiction for all disputes arising from or in connection with these GTC is the registered office of Wealth Investment Network - WENET AG. Wealth Investment Network - WENET AG also has a place of jurisdiction at the registered office/domicile of the user. Mandatory places of jurisdiction remain reserved.
F. Angaben von Personalien
Note: Sämtliche Interessenten-Anfragen werden durch die WENET-Plattform an die Eigentümer/innen weitergeleitet; eine direkte Veröffentlichung von Kontaktdaten im Inserat ist daher nicht erforderlich und unzulässig.
Sanktionen: Bei Verstössen behalten wir uns gemäss diesen AGB vor, den/die Eigentümer/in abzumahnen und/oder das veröffentlichte Objekt ohne Vorankündigung offline zu nehmen und zu deaktivieren. Weitere Massnahmen nach diesen AGB bleiben vorbehalten.
G. Bildrechte und Eigentum
Die Nutzer sind allein für die von ihnen hochgeladenen Bilder verantwortlich. Mit dem Hochladen bestätigen die Nutzer, dass sie rechtmässige Eigentümer der Inhalte sind oder über die erforderlichen Nutzungsrechte verfügen. Die Plattform übernimmt keine Haftung für von Nutzern hochgeladene Bilder.
